The single bench of the Madras High Court had earlier restrained TVS from manufacturing, marketing and selling the 125 cc motorcycle after Bajaj Auto had raised objections.
But the court later set aside its verdict and allowed TVS Motor to sell Flame bikes. However, Bajaj filed a special leave petition in the Supreme Court, challenging the high court verdict.
Last week a two-member Supreme Court bench comprising Justice Markandey Katju and Justice Ashok Kumar Ganguly allowed TVS Motor to sell the disputed model and also directed the Madras High Court to hear the case between the two companies on a daily basis.
The hearing should be concluded by Nov 30 this year, the court said.
